Terms of Service

These Terms govern your use of UGCVideoApp (the "Service") operated by UGCVideoApp, Inc. ("we", "us"). By creating an account you agree to these Terms.

1. Account

• You must be at least 18 to use the Service.
• One account per person. Keep your password confidential.
• You're responsible for activity under your account. Notify us immediately at security@example.com if you suspect unauthorized access.

2. Acceptable use

You may not use the Service to generate content that:

• Infringes third-party intellectual property or rights of publicity.
• Promotes violence, hate, harassment, or sexually explicit material involving minors.
• Impersonates a real person without consent.
• Engages in deceptive practices (scams, financial fraud, political deepfakes).

Briefs are automatically screened by OpenAI's Moderation API. Flagged briefs are rejected. We reserve the right to suspend accounts that repeatedly trigger flags or engage in abuse.

3. Your content

• You retain all rights to the briefs you submit + the videos generated for you. You grant us a limited license to process your content solely to deliver the Service.
• You're responsible for ensuring you have the rights to any third-party material (e.g. brand names, music) referenced in your briefs.
• Generated videos may incorporate stock footage licensed from Pexels under their terms. Avatar likeness is licensed from HeyGen under their terms.

4. Billing

• Paid plans are billed in advance via Stripe. Credits expire 12 months from purchase.
• Refunds within the first 14 days for any reason. After that, unused credits roll over.
• We may change pricing with 30 days written notice. Your current billing period is honored at the rate you signed up at.

5. Service availability

We strive for 99.5% monthly uptime. Status: status.example.com. We don't offer a financial-credit SLA for the standard plan; enterprise plans may include one.

6. Termination

• You can delete your account at any time via /account/delete (30-day grace window).
• We may suspend or terminate accounts that violate these Terms (notice provided where reasonable).
• On termination, your unused credits are forfeited unless the termination is due to our material breach.

7. Disclaimers

The Service is provided "as is" without warranties of any kind. We don't guarantee that generated videos will achieve any particular result on your behalf (engagement, conversion, virality). The output is AI-generated; review it before publishing.

8. Limitation of liability

To the maximum extent permitted by law, our aggregate liability for any claim arising from these Terms is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages.

9. Governing law

These Terms are governed by the laws of the State of Delaware, USA. Disputes will be resolved in the state or federal courts of Delaware, subject to your mandatory-jurisdiction rights under local consumer-protection laws.

10. Changes

Material changes will be notified via email + posted here at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
